1. Who these terms are between
These Terms of Use ("Terms") are a binding agreement between you ("you", "user") and the operator of scanthra.com ("Scanthra", "we"). They govern your use of the Scanthra website and scanning service (together, the "Service"). By using the Service you accept these Terms. If you do not accept them, do not use the Service.
2. What the Service is — and is not
Scanthra performs a passive security review of a public website you submit and emails you a PDF report describing findings, business impact and suggested fixes.
The Service is:
- A best-effort, automated diagnostic tool.
- Informational and educational in nature.
- Free to use during its current phase.
The Service is not:
- A penetration test, security audit, or compliance certification.
- Legal, regulatory or professional security advice.
- A substitute for a qualified security professional, an attorney, or your data-protection officer.
- A guarantee of any kind that your website is secure or compliant with any law, standard or framework.
3. Eligibility and acceptable use
You may only use the Service if you:
- Are at least 18 years old (or the age of majority where you live).
- Are authorised to request a security scan of the domain you submit. This typically means you are the owner, the operator, or you have written permission from the owner.
You agree not to:
- Submit domains you do not own or are not authorised to test.
- Use the Service to harass, defame, or harm any person or organisation.
- Attempt to break, overload, reverse-engineer or otherwise misuse the Service or the infrastructure that runs it.
- Scan domains that we have placed on a deny-list (for example, government, banking and other regulated entities) where automated scanning could trigger an incident response on their side.
- Use the Service in a way that violates any applicable law, regulation or third-party right.
We may rate-limit, suspend or refuse the Service to anyone at any time, at our sole discretion, without explanation.
4. Your representations
By requesting a scan you represent and warrant that:
- You own the domain, or you have explicit authorisation from the owner.
- The email address you provided is yours, and you have the right to receive automated emails from us at that address.
- You understand the Service performs network requests against the submitted domain.
If any of the above is untrue, you bear sole responsibility for the consequences.
5. "As is" — no warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT.
Without limiting the above, we do not warrant that:
- The Service will be uninterrupted, error-free, or available at any particular time.
- The findings are correct, complete, or up to date.
- The Service will detect all (or any) vulnerabilities present on your website.
- The Service will not produce false positives, false negatives, or misclassifications.
- Acting on the report will make your website secure or compliant.
You are responsible for independently verifying any finding before acting on it, and for engaging a qualified professional where the stakes warrant.
6. Limitation of liability
To the maximum extent permitted by applicable law, Scanthra shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, reputation or business opportunity, arising out of or in connection with your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our aggregate liability for any and all claims arising out of or in connection with the Service is limited to fifty euros (EUR 50), or the amount you actually paid us for the Service in the twelve months preceding the event giving rise to the claim, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — for example, liability for gross negligence or wilful misconduct, or statutory consumer rights you may have where you live.
7. Your responsibility for the report
The report we send you is informational. You decide what to do with it. We are not responsible for:
- How you act on, share or publish the report.
- Damages, downtime, legal exposure or reputational harm arising from changes you make based on the report.
- The accuracy of any third-party data the report cites (for example, CVE descriptions).
8. Intellectual property
Scanthra, the Scanthra name, the visual identity, the website, the software, the report layout and the underlying scanning logic are owned by us (or licensed to us) and are protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive licence to use the Service and the report we generate for you, for your own legitimate business or personal purposes.
You may not:
- Resell or sublicense the Service.
- Remove or alter our branding, copyright notices or any link back to scanthra.com in the PDF.
- Use the Service or its outputs to train a competing automated scanner.
9. Third-party services
The Service relies on third-party providers (hosting, email, DNS, monitoring). Their availability and terms are outside our control. Their listing in our Privacy Policy does not imply our endorsement of any other product they offer.
10. Donations and voluntary payments
If we offer an option to support the Service (for example, "Buy Me a Coffee" or a similar tipping channel), any such payment is voluntary, non-refundable, and creates no additional obligation on us — no SLA, no priority support, no extra functionality — unless we explicitly say so in writing.
11. Data protection
Our processing of personal data is described in the Privacy Policy, which forms part of these Terms. By using the Service you confirm that you have read it.
12. Termination
You may stop using the Service at any time and request deletion of your data via /privacy/delete-request.
We may suspend or terminate your access at any time, with or without notice, if we believe you have breached these Terms or that continued access would harm the Service, other users, or third parties.
13. Changes to the Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the Service after a change means you accept the updated Terms. If you do not accept them, stop using the Service and, if you wish, request deletion of your data.
14. Governing law
These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. Mandatory consumer protection rights you have under the laws of your country of residence in the European Union remain unaffected.
Any dispute that cannot be resolved amicably shall be submitted to the courts having jurisdiction over Scanthra's seat in Poland, save where applicable mandatory law assigns exclusive jurisdiction to a different court (for example, to the courts of your country of residence as an EU consumer).
For online dispute resolution, EU consumers may also use the European Commission's ODR platform at ec.europa.eu/consumers/odr.
15. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Scanthra in relation to the Service, and supersede any prior understanding.
